Yes, again it preserves your rights under the law. Just because you believe that you committed the infraction doesn't necessarily mean you deserve a ticket. In every instance, the prosecution must prove that you committed the infraction and that the ticket that you received was a valid one.
DO I NEED AN ATTORNEY TO REPRESENT ME WITH MY TICKET?
No, not necessarily, this is an individual decision. However, an attorney, like Mr. Nguyen, a former prosecutor who knows the system, can give you that extra edge you may need on a procedural issue or maybe you just don't want to miss work, school, or an important meeting.
I MARKED THE "MITIGATION BOX" ON THE BACK OF THE TICKET, CAN I STILL CONTEST THE INFRACTION?
In the majority of cases, your hearing can be changed from mitigation to a contested hearing. Please let our office know if you checked the mitigation box. We can contact the court to change to a contested hearing. Remember by mitigating the infraction you are admitting to the infraction and it will go on your record which could lead to higher insurance rates.
DO I NEED TO APPEAR AT MY COURT HEARING?
When you are represented by an attorney it depends on the Court. In most cases, such as speeding, it is not necessary for you to appear. If you have retained Mr. Nguyen he can appear on your behalf. The benefit is that Mr. Nguyen can appear for you and therefore you do not miss work or school. In most cases your presence does not help or hinder your chances of a favorable outcome. If it would help, then Mr. Nguyen would have you appear at the hearing.
MR. NGUYEN WAS SUCCESSFUL IN GETTING MY TICKET DISMISSED; DO I NEED TO DO ANYTHING ELSE?
No. If your matter was dismissed the Court will enter a dismissal or not-committed finding on the court docketing system and the matter will NOT appear on your driving record.
